Omnex or Omnex Systems may restrict certain secure areas of this Site to authorized users and permit access to these secure areas only by the use of a confidential password. Unauthorized individuals attempting to access such areas of this Site are in explicit violation of these Terms of Use and may be subject to prosecution and applicable damages.

Jurisdictional Issues and Applicable Law

You acknowledge and agree that the laws of the State of New York without regard to conflict of law principles, and applicable federal law, will govern these Terms of Use, your use of the Site, and any dispute of any kind that might arise between you and Omnex or Omnex Systems in connection with the Site. Any action you, any third party, or Omnex or Omnex Systems brings arising out of or in any way connected to this Site and/or these Terms of Use shall be brought exclusively in either the state or federal courts located in New York County, New York, and you expressly consent to the jurisdiction of said courts.

Refund & Cancellation Policy

Americas

Open Enrollment Cancellation Policy

If the client cancels attendance for the course they've registered for with less than 1 week of written notice, (from the starting date of the course), or just fails to show up, the client will be obligated to pay 50% of the registration fee. If the client does not agree to this cancellation policy, it must e-mail Omnex within 48 hours of receipt of the invoice.

Cancellation fee will be waived if: Client substitutes another attendee Cancellation fees will be reduced by 20% if the client and Omnex agree to reschedule the training for a future scheduled date.

On-Site Training or Consulting Scheduling & Cancellation Policy

Every effort will be made to accommodate Client’s scheduling requirements. However, a cancellation or rescheduling of one or more confirmed consulting or training dates, with less than a two week notice, will result in client being billed for the affected days at the applicable daily rate. Omnex will, however, make every reasonable effort to fill the dates opened by the cancellation/rescheduling with another client to offset the cancellation/rescheduling penalty, whenever possible. Omnex reserves the right to reschedule confirmed dates provided that Omnex gives Client a minimum of a two week notice.

Refund Policy

Unless otherwise agreed to in writing, Omnex does not issue refunds to clients for any type of training, consulting, staffing, or software engagement that has completed. Only in circumstances where a payment has been received from a client for a service to be provided at a future date, will a refund be possible. In such scenarios, and depending upon the circumstances involved, (including the Omnex cancellation policies), Omnex will review and process an applicable refund payment.

Asia / Pacific

Payment Terms

Payment Terms: For In House and Open enrolment Program the payment should be made before the first day of the training or at the time of registration. Certificate will be dispatched only after the complete payment
Payment shall be in Indian Rupees and due immediately from the receipt of invoice
PO to be initiated before the training program
In case of TDS (Tax Deduction at Source), the Company shall send the TDS Certificate to Omnex within the working quarter or 3 months whichever earlier
GST of 18% is applicable on all invoices
We need 14 days prior notification, in case of any cancellation
In case of last minute cancellation without any prior intimation to Omnex SPOC/trainer, charges will be incurred as per the actual commercials
Refund – 100% refund will be processed up to 10 business days prior to the training start date. In case of last minute cancellation, only 25% will be refunded or the candidate can wish to enroll for the future dates
Omnex reserves the right to cancel or reschedule the training with a prior intimation to the candidates and 100% refund will be done

Cancellation and/or Rescheduling

Every effort will be made to accommodate Company’s scheduling requirements. However, a cancellation or rescheduling of one or more confirmed consulting or training dates, with less than two (2) weeks’ notice, will result in Company being billed for the affected days at the quoted day rate. However, Omnex will make every reasonable effort to fill the dates opened by the cancellation/rescheduling with another client to offset the cancellation/rescheduling penalty, whenever possible. In addition, Omnex reserves the right to reschedule confirmed dates provided that Omnex gives Company a minimum of two week notice.
